A Young Woman’s Excessive and Abusive Drinking Leads To a DUI, Mental Health Concerns, Depression, Time Incarcerated in Jail, and Marital and Divorce Problems

Jesse had a difficult time keeping a job. As a matter of fact, due to her inactivity and lack of incentive, she was without a job far more often than she was in a job situation. And when she did find a job, she had an exceptionally hard time getting to work when her shift started, she often received less than great performance appraisals, and she called off sick so often that she almost always got fired just a few weeks after she began working. Not unexpectedly, one of the results of Jesse’s less than great employment track record was the fact that she was without much money almost on a daily basis.

Despite Jesse’s shameful employment record and financial misbehavior, nevertheless, by some means she made it a point to drink in a hazardous and abusive manner on a day-to-day basis. Not surprisingly, her excessive drinking also resulted in marital and divorce difficulties over the years.

Based on her abusive and irresponsible drinking, it came as no big shock when Jesse got a fifth DUI. When she went before the court, the judge explained to Jesse that her alcohol-related conduct was deplorable and, as a consequence, he was going to sentence Jesse to spend nine months locked up in jail.

As the judge thought about Jesse’s situation, he couldn’t help but think about how some individuals never “connect the dots” and learn how to live in a mature and responsible manner.

Divorce And Perjury

Why it is difficult to obtain a perjury conviction in a false restraining order or in the case of false accusations made against you by your partner during a divorce? SLAPP (Strategic Lawsuit Against Public Participation) is the reason for this. The Wikipedia definition of SLAPP is: a lawsuit or a threat of lawsuit that is intended to intimidate and silence critics by burdening them with the cost of a legal defense until they abandon their criticism or opposition. Coming out on top of the lawsuit isn’t always the primary goal of the person who files the SLAPP. The plaintiff’s goals are accomplished if the defendant succumbs to fear, intimidation, mounting legal costs or simple exhaustion and abandons the criticism. A SLAPP also has the ability to intimidate others from being active in the debate.

Originally, the CA legislature founded SLAPP to handle a situation between logging companies and environmentalists. The environmentalists wanted to file suit against the logging companies, but the logging companies with their unlimited funding and resources would simply file lawsuit upon lawsuit on the environmentalists to try to wear them down. Therefore the legislature implemented the SLAPP provision to precent logging companies from utilizing lawsuits to silence their opponents.

That very same process is now being twisted and used by the divorce industry to prevent a defendant in a divorce case from filing a perjury charge against their ex, as long as the ex-spouse believes they have good reason for their claims. Therefore this boils down to the fact that during a divorce an individual can make false accusations toward the other person involved so long as they maintain they believe their reasoning is true. Forget the other individual’s due process rights are being violated and they aren’t allowed to sue for perjury. The real downer is when the other individual violates SLAPP rights. Then the innocent party gets to pay for their accuser’s attorney.

Essentially, the challenge with SLAPP is the original idea behind it was noble, however it is now perverted and used to suppress the rights of people suffering through a divorce.

This is just one of the reasons why restraining orders are so tough to beat; and more evidence about how insidious the Divorce Industry is. They’re knowingly allowing liars to request irrelevant charges to separate fathers from their own children.
